Ojas Herbal, an organization formed under the laws of India having its registered office at Shop No. 2/3, Sunita Apartments, Opp. Jain Mandir, Jivdaya Lane, Ghatkopar West, Mumbai, Maharashtra, 400086, India (hereafter referred to as “Ojas Herbal” has conceptualized, adopted and is operating the website (www.ojasherbal.com) including and not limited to software applications, mobile applications, referred to “Digital Assets” offering a variety of Services.

The Privacy Policy (hereafter referred to as “Privacy Policy” has been devised and hosted in accordance with and by following the Information Technology Laws as listed below:

2. Rule 3(1) of the Information Technology (Intermediaries Guidelines ) Rules, 2011
3. Rule 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011

This policy document is an “electronic record” falling in the meaning of section 2(t) of the Information Technology Act 2000 and the rules under the section. This policy is an electronic record and therefore, requires no signature.

The Information provided by User(s) and collected by Ojas Herbal on any of the Digital Assets may be accessed, used, and disseminated for the following purposes, and User(s) explicitly consent to the same:

1. Communicating with the User(s) 
2. Providing the services contemplated under the Digital Assets
3. Providing information on new services
4. Data used for Analytical purposes in anonymous form or as de-identified data and for this purpose, help or assistance can be taken from the affiliates or trusted business partners in India or Outside India for research and development, improving services, comprehending the user experiences, taking consideration of individual needs, and improving the overall health outcome of the users. 
5. Getting the feedback of the users
6. To use the recording of the telephonic conversation, video, and chat consultations with the doctor and other support staff of the Ojas Herbal for legal, training, and quality purposes.
7. Send personalized communications and customized messages about the services offered
8. Link the Digital Assets Account with the other third party(s) accounts including but not limited to Google Fit, Apple Kit, and any other fitness accounts, to keep track of the fitness activities as required to provide the services available on the Digital Assets
9. To send customized messages including but not limited to SMS, emailers, WhatsApp messages, bulk emailers to provide information on the healthcare offers, packages, initiatives, and other promotional activities of Ojas Herbal

When the User(s) communicate through an email campaign shared by Ojas Herbal, User(s) may be redirected to the third-party websites which may collect information about the User(s) device, browser, IP address, operating system, and other information. It is to be noted that third-party websites can also use cookies and other technologies to identify the behavioural patterns of the User(s).

The rights of the user are really important to us and any information provided to us will not be shared with any third party. We try our best to protect the rights of our users and their privacy on the systems and websites handled by us. Having said that, we are not liable for any unlawful or unauthorized disclosures for any personal or confidential information made by third party, that are beyond our control, including those of the courier agencies or the intermediaries that have links to our processing systems. Please also note that the information and the privacy policies might be different for our business partners, advertisers, sponsors, and other associates. We are liable to change our privacy policies at any given point in time, and we request all our users to be aware of any such change by periodically reviewing our policies. Whenever our users avail our services or products, we collect their email addresses, names, phone numbers, and other information, which can be used to send personalized offers, products & services, health information, and other updates based on the interest shown.

Under Rule 3 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 any personal information of the user of the website including the name - first and last name, email address, phone number, mobile phone, contact details, age, date of birth, address, ZIP/Pincode; financial information such as bank account, credit card details, debit card details, or any other financial payment option; medical history; medical records; physical, psychological and mental health conditions; sexual orientation or biometric information is considered to be sensitive personal data and will be available for the view by the user on the website.

Ojas Herbal will not disclose any personal or sensitive information to any third party without prior permission, however, in the following cases, no prior permission will be required if the request for such information is -

1. Important for the legal obligation compliance wherein it will be shared with the Government agencies that are mandated by the law to obtain information for the purpose of verification of identity
2. For the investigation, detection, or prevention of the cyber incidents, prosecution, and punishment of offenses
3. Any personal or sensitive information will be shared with any other person or company in India with the consent of the information provider. This consent is necessary for the execution of the contract between Ojas Herbal and the user

No personal information will be collected without the consent of the user, and the information collected will be used for only lawful purposes, or if it is considered necessary. The information will not be retained longer than what it is required for and shall be used only for the purpose for which it was collected.

The user will be aware of the fact that the information is being collected and with the purpose of collecting the information and its corresponding recipient. The user will also be aware of the names and addresses of the agencies that will be retaining and collecting information. 

The personal and sensitive information will be collected and used only for the purpose for which it has been collected.

An opportunity will be provided to the user to review the information that is being furnished and if required, make the necessary changes. 

An option before the collection of the information will be given to the user not to provide the information. 

The user will have a chance to withdraw their consent later, and therefore, Ojas Herbal can also refuse to provide the goods and services for which information is being collected.

User (s) / you agree that representatives of Ojas Herbal can contact over SMS, WhatsApp, Call, or over Email. The user understands that this consent will override the DND status on his mobile phone.

Ojas Herbal uses “cookies” to track the usage patterns, the trends of the website traffic, and user behavior, and also to record information. Some services provided on this website allow Ojas Herbal and its affiliates to save information locally so that there is no need to re-enter the information next time. We endeavor to make content adjustments and improve the customer service based on the information collected from the cookies, which will not be used to create profiles of users and to be used only in aggregated form.

Ojas Herbal has the right to change or update the policy at any time by putting information on the website. Such changes or updates will be effective immediately after posting on the website.
